View Full Version : Smuggle

Yesterday, a Dutch DJ (who happens to be from my hometown) got extradited to the US, because he was charged with drug smuggling. His trial will start later this year.
But what is the proof the prosecutors have against him?????
A criminal, in return for a reduction in his penalty, pointed at a photograph of the DJ in a magazine, saying that 'this was the man'. That's all the evidence there is. Someone who will take profit from a statement, any statement, and who therefor does not care about the truth in the statement, points at 1, only 1 photograph, and says that the person on that photograph is the dealer.
In a lot of countries, this wouldn't even have been enough proof to start a trial, but apparently this is enough proof to even have someone extradited!!!!!!!!!!!!!!!!!!!!!!
Am I wrong not to feel safe in my own country anymore????????????? What if another criminal points at MY picture????????

I don't know any facts, but I doubt that you know the full facts either. If someone gets extradited you need first of all cooperation, which assumes that the prosecutors in the Netherlands consider the facts to be enough. Nobody gets extradited of his native nation without major proof. And with the facts you presented, nobody could get convicted - even not in the USA.

Extradition to the US from another country is impossible without the cooperation of that other nation-the US fought with France for years to extradite a man in their nation who was convicted of murder in Pennsylvania. In fact, individual US states do not have to send back an individual charged or convicted in another state. For example, if an individual is convicted of a crime in California and found in Illinois, Illinois is under no obligation to cooperate with California.
In order for this DJ to be convicted in an American court, there will be more evidence needed than having his picture singled out. Circumstantial and physical evidence also have to cooberate the prosecution's story.

I agree there has to be more than what your saying to be brought back to the States. They just don't do it on a photo. I'm sure he's been under investagation for awhile probably.

How do I know all this? Well, he's from my hometown, and he's become a local hero out of the blue.
I had hoped that it would take more to get someone extradited. But after September 11th, our government and judges don't have the guts anymore to say no to the US.
Zo zou er tegen K. slechts een verklaring zijn van een anonieme getuige, die bovendien in ruil hiervoor strafvermindering heeft gekregen.
I know that this is in Dutch, but here, it says that the only proof against the man, is a statement from an anonymous witness, in exchange for a reduction in his penalty.
According to Dutch judges (and even the Supreme Court), it is "not up to us to question the validity of the proof".
Well, here you go.

Do not believe in media without questioning the article. And if the judges extradite him without major proof, then you face the problems of the too liberal Netherlands. But there are international agreements on extradition, I can't believe that it is true the way you presented it.

Sure, I do question the media a lot. I'm working on becoming a journalist one day, so I'm the last to accept just about anything. But what if his lawyer says exactly the same? And what if even the prosecutors admit it?????????????????
And yeah, the judges here are too liberal. Or too naive. The result is, that an innocent person is suffering from it.

I know that this is in Dutch, but here, it says that the only proof against the man, is a statement from an anonymous witness, in exchange for a reduction in his penalty He may be anonymous to the public but you can bet whatever he had to say to the legal system must be some kind of proof.

I have no problem with anonymous witnesses. If what they have to say can be proved, then I don't see why someone has to be forced to give his or her name. And if that helps in a conviction, then I think the witness deserves a reward, in the form of a reduction in the penalty.
But what is happening here, is that an entire prosecution is relying on 1 anonymous statement of someone who has an interest in giving a statement, be it true or not. And that is what buggs me.

If all they have is a picture I dont see how the heck thats proof tho, really...there must be alot more to the story for them to feel posotive enough about this man to send him away...not just a picture...
