i was court ordered to go to jury trial for a lady who slipped on a patch of ice about 1ft.x1ft. last winter at a body spa place (with massages, mud baths, ect.) and she wanted like $200,000 for pain and suffering plus medical bills paid and time away from her "hobbies". the only suffering is a broken wrist. and to top it all off she was in a car accident 2 yrs prior to this and got a settlement of $500,000 for a broken arm i bet she was laughing her ass off all the way to the bank on that one. needless to say my opinion was for her to get over it. lucky for the people with common sence that knows ice is slippery people like me was on the jury and she didn't get a single red cent

Welcome Jett and good for you. So many jury's are awarding money for some things that are actually the people that are suing own fault.

I totally agree with you all. Paying out stupid amount of money is just encouraging more dumb claims in those sort of cases. I do believe that some claims for personal injury are necessary, especially if the claimant was some sort of victim.

I was working at Solicitors last summer. I was so surprised about the number of personal injury claims (this is in the UK). I think at no. 1 was the injury Whip-lash. Not far off at no. 2 was loss of hearing (due to heavy machinery in most cases).

I don't think the pay-out for these injuries is so much as in the US or as quick. Someone might correct me on this tho.

thx all! yeah i could see if someone was watering the driveway in the winter "making" ice but they removed as much as possible and she walked right through it cause walking around the 3 square foot of ice would have takin an extra 5 secs. out of her day. either way juriors box should say "smart people only" http://www.dumblaws.com/ubb/biggrin.gif

I know that in the UK it is your responsiblity to make sure that your land (garden path, driveway etc) is safe for members of the public. If you fail to do so then you could find yourself in one of these dumb lawsuits. It is irrelevant whether you invited the person onto your property or not.

She shouldn't have been able to file anything much less had it go all the way to court. Stupidity doesn't deserve to get paid. It's common sense, I'm sure I would have slipped on that ice too but I would know that it was because I'm a retard and could manage to slip and fall on a 1ft by 1ft piece of ice.
