Drunken driving suspect shows up in court - drunk

YORK, Pa. - A man hoping to avoid jail time for a drunken-driving offense made one big mistake - he showed up to court drunk, authorities said.
Richard M. Schenk, 42, was applying to a probationary program for first-time offenders at York County Common Pleas Court on Monday. But a prosecutor and a sheriff's deputy said they couldn't miss the smell of alcohol on him.
Judge Penny L. Blackwell had a breathalyzer brought from the county probation office, and Blackwell said Schenk registered a blood-alcohol level of 0.197 - almost twice the legal limit for driving in Pennsylvania.
Blackwell could have held Schenk in contempt, but instead sent him to York County Prison for the night to sober up. Schenk will still be allowed to apply to the Accelerated Rehabilitation Disposition program, senior prosecutor James Reeder said.
Schenk was arrested in December after he flipped his car in an accident. State police said his blood-alcohol level was 0.230 at the time of his arrest
