This should go in State Laws, I know, but if it's a precedent then I feel it warrants discussion in Politics. Any other states have this little gem on the statutes?

The fact that dealing marijuana and controlled substances is illegal does not exempt it from taxation. Therefore drug dealers are required by law to purchase drug tax stamps.

The drug tax is due as soon as the dealer takes possession of the marijuana or controlled substance. Payment of the drug tax will purchase the drug tax stamps. Attach the stamp to the marijuana and/or controlled substance immediately after receiving the substance. The stamps are valid for 3 months. Drugs seized without stamps or having expired stamps may result in criminal or civil penalties which may include fines, seizure of property or liens against real estate.

A dealer is not required to give his/her name or address when purchasing stamps and the Department is prohibited from sharing any information relating to the purchase of drug tax stamps with law enforcement or anyone else.

Purchasing drug tax stamps does not make possession of drugs legal.

Something in all this does not compute.

It's a remanent law that's still on the books and used to add additional charges to an offender... Marijuana used to be a legal substance.

Other Kansas dumb laws:

Rabbits may not be shot from motorboats.
Pedestrians crossing the highways at night must wear tail lights.
No one may catch fish with his bare hands.
The state game rule prohibits the use of mules to hunt ducks.
If two trains meet on the same track, neither shall proceed until the other has passed.

It makes more sense now :wink

I guarantee if this tax was put in place and was actually enforced, the national deficit would disappear within a week

That's unlikely to happen, tho'. As Bill Hicks pointed out, the war on drugs is being lost. This means that people on drugs are winning. You just need to look at Ben Johnson to see why! :rofl

I actually have some cannibis tax stamps [circa 1930] and a perscription blank for heroin. [around 1935]. I should scan 'em and let you see what they look like. [My father was an expert on U.S. tax and postage stamps. He left quite a collection.]

Catching fish with your bare hands-- it's a sport called "noodling" [or "grabbin'"] and involves wading neck-deep in lakes and rivers probing holes in the banks with your hands. VERY large catfish are known to inhabit such holes, and when you feel one, you stick your hand in the fish's mouth, grab onto the internal gill structure and haul 'em to the surface. Snapping turtles are also known to take up residence in these same holes... a good way to lose a couple of fingers ... or be drowned if the snapper grabs a hand-bone and doesn't bite on through it.

This rather wild-and-wooly "sport" is more prevalent in amongst the rough savages of Oklahoma... and completely unsuitable for the refined folk of Kansas...

Oh... and "no shooting rabbits from a motorboat" is a way to enforce the prohibition of not shooting DUCKS from a motorized craft... "We wuz only Shootin' rabbits..." would've been a common reason given to a Game Warden. "We don't know nothin' 'bout those dead ducks on the water..."

Market hunters in the 1930's would shoot as many ducks as possible from fast motorboats [well... "fast" in relation to rowing said boat] and their excesses in duck/goose kills were the cause of the State and Federal migratory bird laws.

Not all market hunters thought the laws were meant for THEM however...:rolleyes "No shooting rabbits from motorboats" was undoubtedly passed to assist the enforcement of the bag limit laws.

Hey, I just looked up those laws on our very own Dumb Laws website...

I'd be fascinated to see the narcotics tax stamps, Sin. I followed the links on the KRS site to the charges they apply, and, *cough*knowingalittleabouthowmuchdrugscost*cough*, I cannot see how any dealer could pass those charges on to the customer and stay in business.
