Open sex season on Florida prisoners

Here is Florida Statute 944.35 (3)(b)2-4:

2. Any employee of the department who engages in sexual misconduct with an inmate or an offender supervised by the department in the community, without committing the crime of sexual battery, commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.


3. The consent of the inmate or offender supervised by the department in the community to any act of sexual misconduct shall not be raised as a defense to a prosecution under this paragraph.


4. This paragraph does not apply to any employee of the department who is legally married to an inmate or an offender supervised by the department in the community, nor does it apply to any employee who has no knowledge, and would have no reason to believe, that the person with whom the employee has engaged in sexual misconduct is an inmate or an offender under community supervision of the department.

This Statute makes it a crime for a prison guard to **** any prison inmate, or anyone on probation.
HOWEVER, it does not apply to you if you are a guard who is married to someone (ANYONE) who is an inmate or on probation.


It does not matter WHOM you are married to; it does not have to be the same one you are ****ing.
I don't see how it could be clearer!

Please define "sexual misconduct" and how it differs from "sexual conduct" in Florida Statute 944.35(3)(b)2-4. Does the Chapter start with definitions?

cleoeo don't have time to research that so this is just a guess. Misconduct would I think be against someones wishes and conduct would just be doing it with somebody that wants to. JMO

No, I'm afraid the Statute refers to CONSENSUAL sex.
I'll look into it... this does look like another REALLY STUPID Florida law: using "conduct" and "misconduct" to refer to THE SAME BEHAVIOR.

Here is (3)(b)1 of that same Statute:

by any other object, but does not include an act done for a bona fide medical purpose or an internal
search conducted in the lawful performance of the employee's duty.
